FIRE SAFETY

What your fire safety duties actually mean

If you’re a landlord of a multi-occupied residential building, the Fire Safety (England) Regulations 2022 require you to provide residents with fire door and fire safety information, and to carry out regular checks – including quarterly checks of fire doors in the common parts of buildings over 11 metres.

If you’re responsible for a commercial or communal building, the Regulatory Reform (Fire Safety) Order 2005 makes you the “responsible person,” requiring a suitable and sufficient fire risk assessment and the maintenance of adequate general fire precautions. The Fire Safety Act 2021 confirmed this duty extends to external walls, cladding and flat entrance doors in multi-occupied residential blocks.

Since Grenfell, the rules have tightened considerably and now apply at a lower threshold than before: buildings over 11 metres carry additional duties under the Fire Safety (England) Regulations 2022, and the Building Safety Act 2022 introduces further requirements for higher-risk buildings. If you’re unsure which rules apply to your building, a fire risk assessment is the right place to start.
